[6] We offer TWO FORMS of transportation (POINT-TO-POINT and CONTINUOUS CHARTER) and VARIOUS types of services (Pick-ups and Drop-offs, Airport Transfers, Night on the town, Attraction Tours, Dinner Transfers, Wedding, Proms, , Corporate Events, Family Reunions, Conventions, Event Planning, etc.). [7] ALL PAYMENTS DUE PRIOR TO ANY SERVICE PROVIDED. ALL RESERVATIONS (CASH OR CHECK OR CREDIT CARD) MUST BE SECURED WITH A CREDIT CARD AT TIME OF RESERVATION. A HOLD (AUTHORIZATION ONLY) MAY BE PUT ON YOUR CREDIT CARD AT THE TIME OF INITIAL RESERVATION IN ORDER TO SECURE YOUR RESERVATION IN OUR SYSTEM. IF PAYING VIA CREDIT CARD, THE CREDIT CARD MUST BE PHYSICALLY SWPIED/IMPRINTED (AUTHORIZATION AND CAPTURE) AT BEGIN OF SERVICE REGARDLESS OF TIME OF THE INITIAL HOLD (AUTHORIZATION ONLY) ON YOUR CREDIT CARD AND/OR INITIAL RESERVATION WITH US. A CREDIT CARD AUTHORIZATION FORM MAY NEED TO BE COMPLETED PRIOR TO SERVICE IF THE PAYING PARTY WOULD NOT BE PRESENT AT TIME OF SERVICE. [8] Disclosure of your credit card and/or checking account (verbal or facsimile or electronic) to THE COMFORT GROUP, INC. (TCG) establishes a legal contract between us and is a legal authorization to charge your credit card and/or checking account. [9] Verbal Signatures or Facsimile Signatures or Electronic Signatures shall be as effective as if Original Signatures. [10] Due to contractual reasons, all phone calls/voice conversations with our corporation may be monitored and/or recorded. [11] Designating a third party is employing them as Agent-In-Fact on your behalf, thus their roles and signatures are considered the same as yours. [12] You agree that your credit card company does not have the rights and/or jurisdiction to address any service-related dispute that may result from this transaction. [13] Your signature on any of our document prevents your credit card company from addressing any service-related dispute. Use of our services and disclosure of your credit card/checking account information to us constitutes an acceptance of above statement. [14] All Pick-ups and Drop-offs (Point-To-Point Service) have a strict 10 minute wait-time limit due to other contractual constraints. [15] Delays during Point-To-Point services may result in additional charges added to your invoice or the driver leaving. [16] Our web-based reservation system automatically monitors all arriving flights for actual touch-down and delays. After flight arrival, a 30-minute grace period is allowed on all Domestic Arrivals and 60-minute grace period on all International Arrivals. Afterwards, additional charges will apply. [17] We reserve the right to charge for wait time during POINT-TO-POINT service. [18] No body parts outside the vehicles or Standing through the sunroof while in motion. [19] Refreshments (Drinks and Snacks) in our vehicles are COMPLIMENTARY and for use in moderation. Otherwise, a surcharge may apply. [20] Gratuity is apart from our service rate, voluntary on your part, and only added as a convenience if paying via credit card. Gratuity is mandatory for groups of 4 or more. [21] TCG not responsible for presence/consummation of alcohol inside the vehicle, for any item left in our vehicles by passengers, and for the actions and/or inactions of the drivers. [22] TCG reserves the right to cancel service at any time due to non-compliance with driver’s verbal instructions, for any violation of our reservation agreement, to substitute vehicles of comparable value at any time for any reason, to charge your credit card and/or checking account for NO SHOWS, additional charges for services and/or expenses (beyond initial amount on issued invoice), to cancel any reservation at any time due to legal or natural or mechanical or traffic or human reasons without notice. [23] We shall not be liable for injuries, delays caused by accidents, breakdowns, weather/road conditions and other conditions beyond our control. [24] All special reservations also governed by our Special Event Agreement. Offered Discount (Code 121540) automatically changes the contract terms in order for us to meet other obligations. [25] Unpaid invoice subject to 24% APR late fee surcharge and collection activities. [26] TCG reserve the right to charge credit card and/or checking account on file for all unpaid balances or additional charges for services and/or expenses (beyond initial amount on issued invoice). [27] ALL REQUESTS FOR CANCELLATION OF SERVICE UP TO FORTY EIGHT (48) HOURS OF SERVICE TIME MUST BE SUBMITTED VIA EMAIL OR FAX ONLY AND IS AUTOMATICALLY SUBJECT TO A THIRTY PERCENT (30%) ADMINISTRATIVE PROCESSING FEE. [28] ALL REQUESTS FOR CANCELLATION OF SERVICE WITHIN FORTY EIGHT (48) HOURS OF SERVICE TIME MUST SUBMITTED BE VIA EMAIL OR FAX ONLY AND AUTOMATICALLY FORFEITS ALL MONIES REGARDLESS OF TIME OF INITIAL RESERVATION DUE TO LOSS OF REVENUE WHILE HOLDING SAID VEHICLE. [29] We reserve the discretion to issue either Full Refund or Partial Refund or Company Credit towards any Request for Cancellation/Refund. [30] You assume any and all risks of personal injury, property damage, and release and hold harmless TCG from any liability for personal or property damage except due to TCG's gross negligence or intentional acts. [31] A $20.00 Holiday Surcharge would be automatically added to all Holidays on or prior to the actual date of service. [32] Due to contractual reasons, all phone calls/voice conversations with our corporation may be monitored and/or recorded. [12] You agree that your credit card company does not have the rights and/or jurisdiction to address any service-related dispute that may result from this transaction. [13] Your signature on any of our document prevents your credit card company from addressing any service-related dispute. Use of our services and disclosure of your credit card/checking account information to us constitutes an acceptance of above statement. [14] The consumption of any alcoholic beverages or tobacco product or illegal substances is unlawful and not permitted in our limousines. [15] No body parts outside the vehicles or Standing through the sunroof while in motion. [16] No weapons of any kind or intimate relationship / misconduct allowed in the limousine. [17] Gratuity is apart from our service rate, voluntary on your part, and only added as a convenience if paying via credit card. Gratuity is mandatory for groups of 4 or more. [18] TCG not responsible for presence/consummation of alcohol inside any of our vehicles, for any item left in vehicles, for the actions and/or inactions of the drivers. [19] If, at anytime, any of the passengers are found to have in their possession, or have been at anytime during the course of the service, been consuming any alcohol or an illegal substance, the service shall be terminated and all monies shall be forfeited. [20] A $300.00 minimum cleaning fee will be charged to your credit card in the event any damage/abuse of the limousine (interior or exterior) or throwing up in the limousine. [21] TCG reserves the right to cancel service at any time due to non-compliance with driver’s verbal instructions, to substitute vehicles of comparable value at any time for any reason, to charge for No Shows, to add additional charges for services and/or expenses to customer’s credit card, to cancel any reservation at any time due to legal or natural or mechanical or traffic or human reasons without notice. [22] We shall not be liable for injuries, delays caused by accidents, breakdowns, weather/road conditions and other conditions beyond our control. [23] If applicable, you understand and agree that the Prom Special Discount (Code 121540) been offered to you automatically changes your Continuous Charter Service to a Semi-Charter Service per the detailed terms of the service invoice in order for us to be able to meet our other business obligations. [24] Unpaid invoice subject to 24% APR late fee surcharge, legal remedies and collection activities. TCG reserve the right to charge credit card and/or checking account on file for all unpaid balances or additional charges for services and/or expenses (beyond initially issued invoice). [25] ALL REQUESTS FOR CANCELLATION OF SERVICE UP TO FORTY EIGHT (48) HOURS OF SERVICE TIME MUST BE SUBMITTED VIA EMAIL OR FAX ONLY AND IS AUTOMATICALLY SUBJECT TO A FIFTY PERCENT (50%) ADMINISTRATIVE PROCESSING FEE (SAME AS DEPOSIT ALREADY PAID). [26] ALL REQUESTS FOR CANCELLATION OF SERVICE WITHIN FORTY EIGHT (48) HOURS OF SERVICE TIME MUST BE SUBMITTED VIA EMAIL OR FAX ONLY AND AUTOMATICALLY FORFEITS ALL MONIES ALREADY PAID REGARDLESS OF TIME OF INITIAL RESERVATION DUE TO LOSS OF REVENUE WHILE HOLDING SAID VEHICLE.
